Position Summary:

Drafts contracts and resolves various marketing and advertising legal issues of a publicly held retailer. Supports print, TV, radio, in-store and online advertising initiatives. Related areas of practice include consumer protection regulation, trademark, copyright and a wide variety of contracts.

Essential Duties and Responsibilities (include but are not limited to the following):

• Provides counsel in support of the Company’s customer-centric initiatives, including (a) television, print, digital and in-store marketing and advertising campaigns; (b) social media content and related issues; (c) in-store programs, such as Buzz Club Rewards, Freshness Promise and Price Promise; (d) trademarks for advertising slogans and in-house brands; and (e) in-store and online sweepstakes and contests.

• Drafts, reviews, edits and negotiates contracts related to a wide array of matters, including: creative services agreements for marketing and advertising agencies; professional services; sponsorship; online marketing services and tools, such as SEO and analytics; confidentiality agreements; insertion orders; and other commercial transactions.

• Maintains current knowledge of best practices for advertising standards, including recent FTC rulings and BBB Code of Advertising.

• Issues and responds to cease and desist letters regarding trademark and copyright infringement.

• Anticipates and minimizes potential legal risks.

• Researches, reviews and provides counsel regarding various matters involving the Company.

• Coordinates with outside counsel as necessary.

• Other specialized practice areas as assigned by supervisor.

• Addresses other legal projects as requested by management.

Qualifications:

  • Juris Doctorate degree required.
  • Required to be admitted to the bar and in good standing in Ohio or admitted to the bar and in good standing in another state and eligible for admission on motion in Ohio.
  • Minimum of 3 years of relevant experience at a law firm and/or in-house with experience relevant to the essential duties and responsibilities.
  • Some experience handling or familiarity with the following matters is preferred, but not required: (a) national marketing campaigns for a retailer; (b) social media, omnichannel and e-commerce programs; (c) trademarks; and (d) privacy laws relating to omnichannel marketing, including CAN SPAM and COPPA.
  • Knowledge in the areas of privacy and data security is a plus, but not necessary.
  • Ability to work collaboratively with the Company’s management, attorneys and staff, as well as, outside counsel and vendors.
  • Excellent business judgment, problem solving skills, initiative and a strong work ethic required.
  • Excellent verbal and written communication, organizational, and negotiation skills required.
  • Keen attention to detail and the desire to develop additional skills required.
