PayPal is looking for an experienced data privacy lawyer to join its privacy team as Commercial Privacy Counsel. The position is part of the PayPal global privacy organization and reports to PayPal’s global Chief Privacy Officer and Privacy Counsel. Roles and Responsibilities The Commercial Privacy Attorney will focus on supporting the commercial functions of the business, with an emphasis on commercial relationships, marketing, business strategy, and consumer research. As Commercial Privacy Counsel you will use your privacy, data protection, information security and program management expertise to: • Draft and negotiate privacy and data protection-related provisions in complex commercial and technology contracts, including strategic business partnerships, outsourcing, data processing, joint ventures, marketing, merchant agreements, M&A transactions and business dispositions. • Help ensure PayPal businesses negotiate agreements with robust data protection and information security terms appropriate for each jurisdiction involved. • Create privacy playbooks for legal colleagues to empower them to negotiate common privacy and data protection issues; provide training on these materials. • Develop strategy for programmatic privacy integration into vendor review and commercial agreement negotiations; partner with multiple stakeholders in creation and execution of strategy. • Work closely with PayPal’s corporate communications and marketing teams to help ensure that PayPal’s privacy, security and consumer protection practices and commitments are clearly and accurately communicated • Demonstrate in-depth knowledge of marketing practices and their privacy and data protection implications, including email campaigns, OBA, mobile channels, SMS • Demonstrate knowledge of, and experience applying, U.S. privacy regulations and industry guidelines and self-regulatory standards, including CAN-SPAM, COPPA, TCPA, the NAI Code of Conduct. • Oversee integration of data privacy legal team with marketing team, including policy and training development, client relationship development; and day-to-day privacy counsel. • Review proposed data use cases for data governance and access control; ensure consumer and merchant strategy projects integrate data privacy tenets • Participate in strategic development of programs within GDPR framework, together with global legal privacy colleagues developing overall GDPR compliance strategy. This leadership role will also involve: • Managing a team • Helping strategize, design, and implement privacy and data protection-related solutions for all areas of PayPal as a member of PayPal’s global privacy team • Identifying and executing on opportunities to continuously improve our privacy policies and practices • Helping ensure that PayPal colleagues, policies and practices keep up-to-data on changes to applicable privacy, data protection, information security and bank secrecy-related laws, rules and regulations, emerging technologies, and the growth and innovation of our businesses • Developing and maintaining collaborative relationships with, and provide privacy and data protection subject matter expertise to, PayPal’s global commercial and marketing legal team; and business units such as information security, marketing, vendor review, business strategy, consumer research, data governance and other teams within PayPal. • Creating and delivering effective training and enhance awareness of privacy and data protection policies, practices, requirements, opportunities and risks that foster colleagues’ understanding of how privacy and data protection affects their job responsibilities, our customers, and business operations and strategy • Role will also include supporting other privacy team initiatives, depending on team resources and priorities.

Job Requirements:

-- J.D. or equivalent law degree required; admitted to the Bar and licensed to practice law in-house in California
-- Minimum of 10 years direct legal experience required
-- 5 years actively advising global businesses as in-house counsel and/or as outside counsel on privacy, data protection and information security issues required and preferred
-- Experience advising clients in the financial services, mobile payments, e-commerce, internet and technology industries preferred; knowledge of data management and analytics, advertising, and/or retail industries helpful
-- Sound and practical legal and business judgment and critical thinking; collaborative and proactive approach to consulting and problem solving
-- Excellent communications skills, both written and oral
-- Highest standards of and commitment to ethics and integrity
-- Ability to build relationships and trust across the organization
-- Demonstrated ability to work autonomously as well as part of a team, to effectively coach and mentor others (including non-attorneys), a sense of humor and resiliency especially under tight deadlines and while managing multiple priorities
-- Experience managing staff and leading teams, including virtual ones
-- Demonstrated use of, proficiency with, and passion for PayPal products and services
-- CIPP, CISSP, CISA and/or other relevant certifications desirable
-- Ability to travel – approximately 15%
