The Senior Counsel will work as part of a global team of privacy and data protection professionals to ensure privacy and data protection compliance while enabling business innovation. The position will report to Senior Managing Counsel, Privacy and Data Protection.

 

Role

• Enabling the development of data driven products and solutions while ensuring compliance with privacy and data protection laws, utilizing privacy by design methodology;
• Providing guidance for compliance with privacy and data protection laws for marketing and core product business units; and
• Performing detailed analyses of laws and regulations impacting business units to facilitate day to day business operations and assist in achieving major organizational goals.
• Analysis of new products and solutions including: , including, global marketing and digital media initiatives, pre-paid, debit, consumer credit, commercial card, cardholder loyalty products and payment card linked rewards programs;
• Analyze applicable privacy and data protections laws including GLBA, CAN-SPAM, TCPA, PIPEDA, CASL, EU Data Protection Directive, US state privacy laws and similar laws on a global basis;
• Ensure these new products & solutions comply with these laws;
• Review marketing programs for associated data collection and use practices;
• Identify business requirements resulting from new and evolving privacy laws and regulations; and
• Identify technical requirements to enable privacy compliance and work with business and technical teams to assist implementation; and
• Review and negotiate privacy and data protection terms with customers and vendors.

 

All About You

• Bachelor and Juris Doctorate degrees, member of New York State Bar
• Significant experience in privacy and data protection
• Legal expertise in combination of interactive technology, product development, digital media and marketing, emerging payments and loyalty and rewards programs.
• Ability to think and act both strategically and tactically with respect to the needs of business clients and their objectives while ensuring that the corporation remains compliant with law, and industry best practices.
• Experience dealing with GLBA, CAN-SPAM, CASL, EU Data Protection Directive, US state data protection and privacy laws and other similar privacy and data regulatory requirements on a global basis;
• Experience with interactive marketing and digital media technologies, including cookies and other data collection and tracking technologies;
• Familiarity with loyalty and rewards programs;
• Familiarity with financial services industry and payment processing;
• Experience in the conduct of e-commerce;
• Familiarity with advertising industry best practices for collection and use of data, including NTIA guidelines, DAA guidelines, FTC behavioral advertising guidelines, Mobile Marketing Association’s best practices, and Direct Marketing Association ethical rules;
• Motivated self-starter with ability to excel at multi-tasking in a fast paced environment;
• Superior time management, planning and organizational skills;
• Strong analytic capabilities and written and oral communication skills;
• Exceptional interpersonal skills with proven experience in relationship building and partnering; must work well in both team and individual settings; and
• Ability to work well as part of a team of geographically dispersed highly skilled professionals.
